Terms and Conditions for Commu's Commissions

1. Acceptance of Terms

By requesting or using Commu's services, you ("Client") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all clients, including first-time customers, returning clients, and anyone interacting with Commu regarding commissions. If you do not agree to these Terms, do not commission or use Commu's services.

2. Services and Use

Commu provides scripting and GFX (graphics) services for Roblox and other platforms. By commissioning Commu, you agree to provide accurate information and any necessary materials for the project.

Eligibility: You must be at least 13 years old to request commissions. If you are under 18, you confirm you have a parent or guardian's permission to enter into this agreement and to make any associated payments.

Account Responsibility: If you provide account or asset access to Commu, you do so at your own risk and are solely responsible for maintaining the confidentiality of your login credentials and information. Commu is not responsible for any loss, damage, or unauthorized access resulting from Client-provided account access.

Right to Refuse or Discontinue Service: Commu reserves the right, at his sole discretion, to decline any commission request, or to discontinue work already in progress, for any reason, including but not limited to violations of these Terms, abusive conduct, or requests that fall outside Commu's intended scope of work. Where work has already begun, any refund (if applicable) will be determined solely by Commu in accordance with Section 5.

Non-Binding Requests: A commission request is not binding on Commu until it has been explicitly confirmed by Commu and any required payment or deposit has been received.

Prohibited Activities: You agree not to misuse Commu's services, including but not limited to:

Requesting scripts, assets, or content intended for exploits, cheats, griefing, or other malicious or illegal purposes.

Requesting content that infringes on third-party intellectual property rights.

Harassing, threatening, defaming, or making false public claims about Commu or other clients.

Attempting to chargeback or reverse payment for completed or in-progress work without first attempting to resolve the issue directly with Commu.

Submitting excessive, repetitive, or bad-faith communications intended to pressure, harass, or rush Commu outside of agreed timeframes.

3. Ownership, Content, and Licensing

Client-Provided Assets: You retain ownership of any assets you provide for the commission.

Default License for Delivered Work: Unless a specific commission agreement states otherwise in writing, all completed works (including but not limited to scripts, graphics, thumbnails, icons, and any other deliverables) produced by Commu are licensed to the Client under the following terms, effective only upon full payment:

Grant: Commu grants the Client a non-exclusive, non-transferable, non-sublicensable license to use, publish, and display the delivered work for the specific purpose, platform, or project agreed upon at the time of commissioning.

No Resale as a Standalone Asset: The Client may not resell, redistribute, or relicense the delivered work as a standalone asset — separately from the project or platform it was created for — whether for free or for payment, without Commu's prior written permission.

No Modification or Derivatives: The Client may not modify, alter, remix, or create derivative works from the delivered work (including recoloring, cropping, combining with other assets, or editing script source to build new standalone scripts) without Commu's prior written permission — except for modifications reasonably necessary for standard technical integration, such as resizing an icon to fit a required dimension, or configuration changes explicitly permitted at the time of delivery.

Scope: This license covers only the platform, project, or use case agreed upon at the time of commissioning. Using the delivered work in a different or unrelated platform, product, or project not covered by that original agreement requires separate permission from Commu and may incur an additional licensing fee.

Attribution: Credit to Commu is appreciated but not required unless otherwise agreed in writing for a specific commission.

Revocation: This license is granted subject to the Client's continued compliance with these Terms. Commu may revoke this license, in whole or in part, at any time if the Client breaches any provision of these Terms — including but not limited to non-payment, chargebacks, harassment, or unauthorized redistribution — regardless of whether the breach directly relates to use of the license itself.

No License Prior to Full Payment: No license of any kind is granted until full payment for the applicable commission has been received, per the "License and Delivery Contingent on Payment" provision below.

License and Delivery Contingent on Payment: No license, ownership right, or usage right in any deliverable transfers to the Client until full payment has been received. Any files, previews, or drafts shared with the Client prior to full payment remain the sole property of Commu, may include visible watermarks or reduced-quality previews, and may not be used, published, or distributed by the Client for any purpose.

Overrides: Any different or additional licensing terms for a specific piece of work — such as an exclusive license, resale rights, or expanded usage rights across multiple platforms — must be explicitly agreed to in writing by Commu (e.g., in the project agreement, invoice, or file metadata). In the absence of such a statement, the default license above applies.

Portfolio Use: Regardless of the license granted to the Client, Commu retains the right to display, reference, and use completed commissions (scripts and graphics), including work-in-progress previews, for portfolio, promotional, and social media purposes, unless the Client explicitly requests otherwise in writing prior to project completion.

Client Responsibility for Provided Content: You are solely responsible for ensuring that any content, references, or materials you provide are accurate, legal, and non-infringing. Commu is not liable for any issues, claims, or damages arising from illegal, copyrighted, or otherwise harmful content supplied by the Client.

Indemnification: You agree to indemnify and hold Commu harmless from any claims, damages, losses, or expenses (including legal fees) arising from your misuse of delivered work, your breach of these Terms, or content you provided for a commission.

4. Intellectual Property

Except for the license granted to the Client under Section 3, Commu retains all intellectual property rights over the scripts, designs, and graphics he creates, including underlying source files, techniques, render/project files, and reusable components. Source files (including but not limited to Blender project files, script source files, and layered graphic files) are not included in any delivery unless explicitly agreed to in writing and paid for separately.

You may not copy, distribute, sell, sublicense, or create derivative works from Commu's original creations beyond what is expressly permitted under the applicable license (see Section 3) without Commu's prior written permission.

5. Payment, Refunds, and Cancellations

Refunds are generally not provided once work has begun, unless explicitly agreed upon in writing prior to starting the commission.

All payments are final once work commences, except where required otherwise by applicable law.

Chargebacks or payment disputes filed without first contacting Commu to resolve the issue may result in the Client being barred from future commissions and pursuit of the disputed amount through applicable means.

Cancellation Refund Discretion: Where a partial refund is offered for a cancellation (e.g. up to 70%), this amount is discretionary and not guaranteed. Commu may reduce, withhold, or revoke any such refund offer for any reason whatsoever, and carries no liability to issue a refund in any circumstance beyond what is legally required. Where Commu does choose to issue a refund, the Client will receive only the amount Commu actually received after any platform fees or taxes (including Roblox-imposed taxes, where applicable) — Commu is not required to, and will not, cover or reimburse taxes or fees deducted from a refund.

Payment Delays: Commu reserves the right to pause, delay, or deprioritize work on any commission where payment is overdue, incomplete, or disputed, without any liability for delays this causes to the agreed timeframe.

Client Non-Response: If a Client fails to respond to requests for information, feedback, or required materials for more than fourteen (14) consecutive days, Commu may pause or archive the commission. Resuming an archived commission may require an additional fee and is subject to Commu's availability at the time.

6. Delivery and Revisions

Commu will make reasonable efforts to deliver work within the estimated timeframe discussed, but timeframes are estimates, not guarantees, and may be affected by factors outside Commu's control.

6.1 Definitions

"Minor Revision" means a change that does not require the thumbnail, icon, or graphic to be regenerated through the 3D rendering pipeline — for example, text edits, color/filter adjustments, cropping, or basic compositing tweaks made in post-processing.

"Re-render" means any requested change that requires the scene to be reopened and reprocessed in Blender (or an equivalent 3D rendering application) to produce a new render output — including, but not limited to, changes to camera angle, lighting, poses, materials, object placement, or overall scene composition.

6.2 Included Revisions

Up to two (2) re-renders per thumbnail or icon, per commission, are included in the original commission price at no additional charge, provided the requested change is reasonable and falls within the original agreed scope. A reasonable number of Minor Revisions (non-render) are also included, at Commu's discretion, as agreed at the start of the commission.

6.3 Additional Re-render Fees

Once the two (2) included re-renders have been used, any further re-render requested for that same thumbnail or icon will incur an additional fee, charged per required re-render as follows:

3rd re-render: $7.50

4th re-render: $12.50

5th re-render: $17.50

6th and every subsequent re-render: $20.00 (maximum, does not increase further)

Each fee tier increases by $5.00 over the previous tier until the $20.00 maximum is reached, after which the fee remains capped at $20.00 per re-render for the remainder of that commission. These fees apply per required re-render, per individual thumbnail or icon, per commission — separate thumbnails/icons within a multi-piece commission are tracked and billed independently. Applicable re-render fees must be paid before the newly re-rendered file is delivered, and Commu is under no obligation to begin the re-render before payment is received.

6.4 Scope of Revisions

Revision requests should be submitted as a single, consolidated list wherever possible. Requests submitted piecemeal or in multiple separate rounds may, at Commu's discretion, be treated as separate revision rounds and billed accordingly under Section 6.3. Substantial changes, scope changes, or additional requests beyond the original agreement (including requests that go beyond revising the existing concept, such as an entirely new concept, pose, or scene) are not covered by the included revisions above and may incur separate extra fees and/or extend the delivery timeline, regardless of how many re-renders have been used.

7. Disclaimers

No Warranty: Commu provides all services and deliverables "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Outcome: Commu strives for accuracy, quality, and functionality in scripts and graphics but cannot guarantee flawless or uninterrupted performance due to limitations, updates, or changes in Roblox, third-party tools, or platforms outside Commu's control. Commu is not responsible for issues arising from platform changes, moderation actions, or third-party service outages after delivery.

No Guarantee Against Misuse: Commu is not responsible for how the Client or any third party subsequently uses, modifies, or distributes delivered work in violation of these Terms.

Force Majeure: Commu is not liable for any delay or failure to perform resulting from causes beyond his reasonable control, including but not limited to illness, power or internet outages, hardware or software failure (including Blender, Discord, Roblox, or other platform outages), or other unforeseen circumstances.

8. Limitation of Liability

To the fullest extent permitted by law:

Commu's total liability arising out of or related to any single commission shall not exceed the total amount paid by the Client for that specific commission.

Commu's aggregate liability to any one Client across all commissions, whether arising under one agreement or several, shall not exceed the total amount paid by that Client to Commu in the twelve (12) months preceding the claim.

Commu is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of profits, data, goodwill, or business opportunity, arising from commissioned work, its use, or its misuse, even if Commu has been advised of the possibility of such damages.

Commu is not liable for any harm, loss, or damages resulting from Client-provided materials, Client's misuse of deliverables, or third-party actions (including but not limited to Roblox Corporation's actions).

9. Harassment and Abusive Conduct

Commu reserves the right to immediately terminate any ongoing commission, refuse future service, and withhold further communication with any Client who engages in harassment, threats, defamation, or abusive conduct toward Commu. No refund will be owed in such circumstances beyond what is required by law.

10. Communication

Commu will make reasonable efforts to respond to Client communications in a timely manner but is not obligated to be available at all times or to respond outside of reasonable timeframes. Repeated or excessive follow-up messages sent within an unreasonably short window may be treated as a violation of Section 9 at Commu's discretion.

11. Changes to Terms

Commu reserves the right to modify these Terms at any time. Updated Terms will be posted and are effective immediately upon posting. Continued use of Commu's services after updates constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Governing Law

These Terms and your use of Commu's services are governed by the laws of the United States of America, specifically the state that Commu currently resides in, that being Washington State, without regard to conflict-of-law principles.
