Terms and Conditions for Commu's Roblox Commissions

1. Acceptance of Terms
By requesting or using Commu's services, you ("Client") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all clients, including first-time customers, returning clients, and anyone interacting with Commu regarding commissions. If you do not agree to these Terms, do not commission or use Commu's services.
2. Services and Use
Commu provides scripting and GFX (graphics) services specifically for Roblox. By commissioning Commu, you agree to provide accurate information and any necessary materials for the project.
  • Eligibility: You must be at least 13 years old to request commissions. If you are under 18, you confirm you have a parent or guardian's permission to enter into this agreement and to make any associated payments.
  • Account Responsibility: If you provide account or asset access to Commu, you do so at your own risk and are solely responsible for maintaining the confidentiality of your login credentials and information. Commu is not responsible for any loss, damage, or unauthorized access resulting from Client-provided account access.
  • Prohibited Activities: You agree not to misuse Commu's services, including but not limited to:
    • Requesting scripts, assets, or content intended for exploits, cheats, griefing, or other malicious or illegal purposes.
    • Requesting content that infringes on third-party intellectual property rights.
    • Harassing, threatening, defaming, or making false public claims about Commu or other clients.
    • Attempting to chargeback or reverse payment for completed or in-progress work without first attempting to resolve the issue directly with Commu.
3. Ownership, Content, and Licensing
  • Client-Provided Assets: You retain ownership of any assets you provide for the commission.
  • Default License for Delivered Work: Unless the delivered image file's metadata or agreement explicitly states otherwise, all completed works (scripts, graphics, and other deliverables) produced by Commu are licensed to the Client under the Creative Commons Attribution-NoDerivatives 4.0 International License (CC BY-ND 4.0) (full license legal code here). This means the Client may use and share the delivered work as-is, with attribution to Commu, but may not modify, remix, or create derivative works from it without Commu's separate written permission. I personally will not enforce having to link the license, but violating any other terms will result in action. Credits may be provided via group rank, description, or any other agreed upon method. If no credit is provided, you may be held liable if these terms were shared with you. If terms were not shared, then aspects may be discredited, but licensing still remains.
  • Overrides: Any different or additional licensing terms for a specific piece of work must be explicitly stated in that work's image metadata (or otherwise confirmed in writing by Commu). In the absence of such a statement, the CC BY-ND 4.0 default applies.
  • Portfolio Use: Regardless of the license granted to the Client, Commu retains the right to display, reference, and use completed commissions (scripts and graphics) for portfolio, promotional, and social media purposes, unless the Client explicitly requests otherwise in writing prior to project completion.
  • Client Responsibility for Provided Content: You are solely responsible for ensuring that any content, references, or materials you provide are accurate, legal, and non-infringing. Commu is not liable for any issues, claims, or damages arising from illegal, copyrighted, or otherwise harmful content supplied by the Client.
  • Indemnification: You agree to indemnify and hold Commu harmless from any claims, damages, losses, or expenses (including legal fees) arising from your misuse of delivered work, your breach of these Terms, or content you provided for a commission.
4. Intellectual Property
  • Except for the license granted to the Client under Section 3, Commu retains all intellectual property rights over the scripts, designs, and graphics he creates, including underlying source files, techniques, and reusable components.
  • You may not copy, distribute, sell, sublicense, or create derivative works from Commu's original creations beyond what is expressly permitted under the applicable license (see Section 3) without Commu's prior written permission.
5. Payment, Refunds, and Cancellations
  • Refunds are generally not provided once work has begun, unless explicitly agreed upon in writing prior to starting the commission.
  • All payments are final once work commences, except where required otherwise by applicable law.
  • Chargebacks or payment disputes filed without first contacting Commu to resolve the issue may result in the Client being barred from future commissions and pursuit of the disputed amount through applicable means.
6. Delivery and Revisions
  • Commu will make reasonable efforts to deliver work within the estimated timeframe discussed, but timeframes are estimates, not guarantees, and may be affected by factors outside Commu's control.
  • A reasonable number of minor revisions may be included as agreed at the start of the commission. Substantial changes, scope changes, or additional requests beyond the original agreement may incur extra fees and/or extend the delivery timeline.
7. Disclaimers
  • No Warranty: Commu provides all services and deliverables "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Guarantee of Outcome: Commu strives for accuracy, quality, and functionality in scripts and graphics but cannot guarantee flawless or uninterrupted performance due to limitations, updates, or changes in Roblox, third-party tools, or platforms outside Commu's control. Commu is not responsible for issues arising from Roblox platform changes, moderation actions, or third-party service outages after delivery.
  • No Guarantee Against Misuse: Commu is not responsible for how the Client or any third party subsequently uses, modifies, or distributes delivered work in violation of these Terms.
8. Limitation of Liability
To the fullest extent permitted by law:
  • Commu's total liability arising out of or related to any commission shall not exceed the total amount paid by the Client for that specific commission.
  • Commu is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of profits, data, goodwill, or business opportunity, arising from commissioned work, its use, or its misuse, even if Commu has been advised of the possibility of such damages.
  • Commu is not liable for any harm, loss, or damages resulting from Client-provided materials, Client's misuse of deliverables, or third-party actions (including Roblox Corporation's actions).
9. Harassment and Abusive Conduct
Commu reserves the right to immediately terminate any ongoing commission, refuse future service, and withhold further communication with any Client who engages in harassment, threats, defamation, or abusive conduct toward Commu. No refund will be owed in such circumstances beyond what is required by law.
10. Changes to Terms
Commu reserves the right to modify these Terms at any time. Updated Terms will be posted and are effective immediately upon posting. Continued use of Commu's services after updates constitutes acceptance of the revised Terms.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Governing Law
These Terms and your use of Commu's services are governed by the laws of the United States of America, specifically the state that commu currently resides in, that being Washington State without regard to conflict-of-law principles.

If I do choose to refund you, I will refund you what I received, and you will receive the amount that you receive after roblox taxes. I am not required to, nor will I cover taxes on your refund.
